Mediation is when an impartial mediation helps both sides work out an agreement.  Mediation's between parents and the LA, and we can support in the mediation meeting and gathering evidence.

The letter from the LA will outline the mediation companies you can contact and they do not charge for mediation certificates.

Anything discussed in the mediation cannot be used a subsequent tribunal hearing. 

Using mediation does not affect your right to appeal to the SEND tribunal.

 

​Your Support for SEND case worker will prepare for the mediation with you and liaise with the mediator.  They will support you at the mediation and is able to speak on your behalf and ask the LA any questions.

Mediation is about understanding the issues of the disagreement and trying to solve them.

It is not about 'who is right or wrong' and it will focus on the present and future.

The mediator manages the mediation meeting and ensures that everyone has their say and are listened to.

Mediation can usually last 2-3 hours and you are able to take a break at anytime to discuss anything with your case worker.

​The LA have to send a representative that is allowed to make decisions on that day.

An agreement is written up by the mediator and a mediation certificate issued within 3 working days.

You then have 1 month from the date on the the mediation certificate to appeal to SENDIST tribunal.

Support for SEND (formally Solihull SEND Consultancy) is managed by Helen Ingham.  The company was set up as Solihull SEND Consultancy in October 2016 to try and make a difference to families in Solihull that were finding it more and more difficult to access the ever dwindling free services available to them.
